Understanding Waqf and its violation

Question:

I want to understand the concept of Waqf in Islam:

a.] What is the definition of Waqf according to the Shariah?

b.] If a building (for example a Masjid) is Waqf, how would the rights of this Waqf be violated (by visitors)?

c.] Would it be allowed to use the electricity of a Masjid to charge your phone?

d.] Would it be allowed to use the water from the Wudhukhana to boil (tea) water?

As-salฤmu โ€˜alaykum wa-rahmatullฤhi wa-barakฤtuh. 

1) The literal meaning of waqf is “to stop” and in Shariah it means to assign a property in the ownership of Allah in which the benefits are spent on those whom the waqf is assigned for.[1]

2) In principle, the rights relating to the use of the waqf property may be separated into three categories:

  1. Rights given by the Wฤqif[2]: This refers to all rights, verbal or written, conferred by the Waqif himself. Examples of this would be the appointment of an Imam, appointment of a muazzin, and instructions on how to use the waqf property itself.
  2. Rights given to the managers (mutawallฤซs) of the Masjid[3]: In simple terms, this refers to all rights handed over to the managers of the Masjid by the Wฤqif himself. This may include all rights mentioned under number one or anything relating to the general use of the waqf property, its equipment, and the revenue generated by the use of a waqf property.
  3. Rights relating to common practice (‘urf)[4]: This includes general use of the Masjid as is common amongst the people of the area. Simple examples of this would be the right to pray during the five times of prayer, the use of the wudu station for ablution, and the use of the restroom. This category differs from region to region as common practice is defined by the people themselves. For example, if it is the norm in a certain area to allow the musallฤซs to use the masjid during the nights of Ramadan for ‘Ibฤdah, then using the lights, electricity, air conditioner/heating, etc. during these nights will not be regarded as being against the rights of the waqf.

In summary, any use of the Masjid that is neither sanctioned by the Wฤqif and the managers of the Masjid nor conforms to the general use of the Masjid will be in violation of the waqf property. It goes without saying that such use means that one utilizes the property of the Masjid with moderation without any form of isrฤf (e.g. not using an excessive amount of water for wudu, etc.).

3) As explained under answer number two, any usage of the Masjid property explicitly allowed by the wฤqif, the managers of the Masjid, or any usage of the Masjid regarded to be the norm in a certain area will be permitted as long as it does not lead to abuse. In regards to your specific query, using the Masjid’s electricity for the purpose of charging one’s cell phone does not fall under any of these categories. As such, it is best to avoid using the Masjid’s electricity for such a purpose.[5]

It is important to take note that if one is residing in the Masjd (such as an Imam, a traveller, a person performing i’tikฤf, etc.) and uses the electricity for such a purpose, then he should discharge a certain portion of his wealth for the donation of the Masjid. While doing so, one should estimate the cost of electricity for his specific usage and pay accordingly. [6]

4) The purpose of the Wudu station is specifically for ablution only. As such, it will be against the rights of the Masjid to use such water to make tea.[7] Furthermore, many Masฤjid contain separate kitchens specifically meant for such purposes. One may utilize the water in the kitchen for such needs if the managers of the Masjid allow him to do so.
