Returning book with illustrations

Question:

I have a book that I borrowed from my school’s library as a child, I lost it and like 7 years on I have the book now, but this book has illustrations (drawings) of people and I do not know whether I can return this book with such drawings, or should I instead destroy it.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, since you borrowed the book from the library, it is incumbent on you to return the book to its actual owner. If you destroy or damage the book, you will be liable to compensate the owner.[1] Furthermore, as long as the book is closed and the illustrations are not openly visible to the eye, it is permissible to keep the book inside your house until you return it.[2] However, since this item does not belong to you, you should hasten in returning the item to the library in order to fulfill your responsibilities as an honest Muslim.

قال الحصكفي لِعَدَمِ لُزُومِهَا (يَرْجِعُ الْمُعِيرُ مَتَى شَاءَ) وَلَوْ مُوَقَّتَةً أَوْ فِيهِ ضَرَرٌ فَتَبْطُلُ، وَتَبْقَى الْعَيْنُ بِأَجْرِ الْمِثْلِ كَمَنْ اسْتَعَارَ أَمَةً لِتُرْضِعَ وَلَدَهُ وَصَارَ لَا يَأْخُذُ إلَّا ثَدْيَهَا فَلَهُ أَجْرُ الْمِثْلِ إلَى الْفِطَامِ وَتَمَامُهُ فِي الْأَشْبَاهِ

[قال ابن عابدين] (قَوْلُهُ: فَتَبْطُلُ) أَيْ بِالرُّجُوعِ (قَوْلُهُ: فَلَهُ أَجْرُ الْمِثْلِ) أَيْ لِلْمُعِيرِ، وَالْأَوْلَى: فَعَلَيْهِ أَيْ عَلَى الْمُسْتَعِيرِ

[قال التمرتاشي] وَلَا تُضْمَنُ الْهَلَاكِ مِنْ غَيْرِ تَعَدٍّ

[قال ابن عابدين] (قَوْلُهُ بِالْهَلَاكِ) هَذَا إذَا كَانَتْ مُطْلَقَةً فَلَوْ مُقَيَّدَةً كَأَنْ يُعِيرَهُ يَوْمًا فَلَوْ لَمْ يَرُدَّهَا بَعْدَ مُضِيِّهِ ضَمِنَ إذَا هَلَكَتْ كَمَا فِي شَرْحِ الْمَجْمَعِ وَهُوَ الْمُخْتَارُ كَمَا فِي الْعِمَادِيَّةِ اهـ قَالَ فِي الشُّرُنْبُلَالِيَّةِ: سَوَاءٌ اسْتَعْمَلَهَا بَعْدَ الْوَقْتِ أَوْ لَا، وَذَكَرَ صَاحِبُ الْمُحِيطِ وَشَيْخُ الْإِسْلَامِ: إنَّمَا يَضْمَنُ إذَا انْتَفَعَ بَعْدَ مُضِيِّ الْوَقْتِ؛ لِأَنَّهُ حِينَئِذٍ يَصِيرُ غَاصِبًا أَبُو السُّعُودِ
